1. Overview
FornaxLink, LLC respects the intellectual property rights of others and expects users of Tavvi to do the same. We respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512. This policy describes how to submit a takedown notice, how an accused user can submit a counter-notice, and our policy for terminating repeat infringers.
2. Designated Agent
Pursuant to 17 U.S.C. § 512(c)(2), FornaxLink has designated the following agent to receive notifications of claimed infringement:

3. Filing a Takedown Notice
To submit a takedown notice, send a written communication to our Designated Agent that contains all of the following, signed under penalty of perjury:
- A physical or electronic signature of the person authorized to act on behalf of the copyright owner
- Identification of the copyrighted work claimed to have been infringed, or a representative list of works at the same site
- Identification of the material that is claimed to be infringing and a URL or other location specific enough for us to find it (for example:
tavvi.fornaxlink.com/@handleportfolio image #3, or the relevant inquiry ID and approximate message timestamp) - Your contact information — name, postal address, telephone, email
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed
Notices missing any of these elements may be rejected or held until you provide the missing information. We recommend filing by email to dmca@fornaxlink.com for fastest processing.
4. What Happens After You File a Notice
Upon receipt of a notice that complies with Section 3 above:
- We acknowledge receipt within 2 business days
- We promptly remove or disable access to the allegedly infringing material
- We notify the user who posted the material, providing them a copy of your notice (minus your phone number; we retain your name, address, and email for their counter-notice option)
- We inform that user that they may file a counter-notice as described in Section 5 below
- We record the action in the user's account for repeat-infringer tracking purposes (Section 6)
Removal of allegedly infringing material is not an admission that the material in fact infringed any right. It is a safe-harbor response under the DMCA.
5. Counter-Notice
If material you posted has been removed and you believe in good faith that it was removed by mistake, or that you have the right to post it, you may submit a counter-notice to our Designated Agent. A counter-notice must include all of the following, signed under penalty of perjury:
- Your physical or electronic signature
- Identification of the material that was removed and the location where it appeared before removal
- A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification
- Your name, postal address, and telephone number
- A statement that you consent to the jurisdiction of the United States District Court for the Northern District of Georgia (if your address is within the United States) or to a federal court with personal jurisdiction over you (if your address is outside the United States), and that you will accept service of process from the original complaining party or its agent
Upon receipt of a valid counter-notice, we forward a copy to the complaining party and inform them that we will restore the material in 10 to 14 business days unless they file a court action seeking a restraining order against you. If the complaining party does not file such an action and notify us, we restore the material.
6. Repeat Infringer Policy
We terminate the accounts of users who, in our reasonable judgment, are repeat infringers. The threshold is generally three (3) substantiated takedown notices within a rolling twelve-month period that the user has not successfully counter-noticed. A single instance of egregious or willful infringement can trigger immediate termination without the three-strike count.
"Substantiated" means a takedown notice that complies with Section 3, was not retracted by the complaining party, and was not successfully counter-noticed by the accused user.
7. Misrepresentations
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents in a takedown notice or a counter-notice that material is infringing or was removed by mistake or misidentification may be liable for damages, including costs and attorneys' fees, incurred by the alleged infringer, by the copyright owner or the owner's licensee, or by the service provider, who is injured by such misrepresentation.
Do not file a takedown notice for content you do not own and are not authorized to act for. Do not file a counter-notice for material you know was correctly removed. We may, in our discretion, refer abusive filings to law enforcement and to the affected party for civil action.
8. Trademark and Other IP Claims
The DMCA process applies to copyright claims. For trademark infringement, right-of-publicity, defamation, or other non-copyright intellectual property claims, write to admin@fornaxlink.com with "IP Claim — Non-Copyright" in the subject line and a description of the issue. We will review and respond within 10 business days.
9. Updates to This Policy
We may update this DMCA Policy from time to time. Material changes will be announced via prominent notice on this page. The "Last Updated" date at the top of this page reflects the most recent material change.
